2.1 The images of the Products on our website are for illustrative purposes only. Your Products may differ from these images.
2.2 Whilst we have made every effort to be as accurate as possible, all sizes, weights, capacities, dimensions and measurements listed on our website are for illustrative purposes only.
2.3 The packaging of the Products may differ from that shown in the images on our website.

6. EVENTS OUTSIDE OUR CONTROL
6.1 We will not be responsible or liable for any failure to perform or delay in performing any of our obligations under a Transaction caused by an Event outside our control. An Event Outside Our Control is defined below in clause 17.2.
6. 2 "Event Outside Our Control" means any act or event beyond our reasonable control, including but not limited to strikes, lockouts or other industrial action by third parties, civil commotion, riots, civil commotion, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, storm, flood, earthquake, subsidence, epidemic or other natural disaster or failure of public or private telecommunication networks or inability to use railways, ships, aircraft, motor transport or other public or private means of transport.
6.3 If an "Event Outside Our Control" occurs that affects the performance of our obligations under a Transaction:
(a) we will contact you as soon as reasonably practicable to notify you; and
(b) our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. If the Event Outside Our Control affects the delivery of the Products to you, we will arrange with you a new delivery date after the Event Outside Our Control has passed.
7. COMMUNICATIONS BETWEEN US
7.1 When we refer, in these Terms, to "in writing", this will include email.
7.2 If you wish to communicate with us in writing, or if any clause in these Terms requires you to give us written notice, you may send it to us by email to sales@elysianys.gr or by prepaid post to Elysian Yachting Services. Ltd, 90 D. Moutsopoulou Street, 18541 Piraeus, GREECE. We will confirm receipt in writing by contacting you, usually by email. If you are a consumer and you are exercising your right to cancel under clause 9, please refer to clause 9 for how to tell us.
7.3 If we need to contact you or notify you in writing, we will do so by email or by prepaid post to the address you gave us on your order.
8. OTHER IMPORTANT TERMS
8.1 We may transfer our rights and obligations under a Transaction to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you by posting on this website if this happens.
8.2 You may only transfer your rights or obligations under these Terms to another person if we agree in writing
8.3 This transaction is between you and us. No other person will have any right to enforce any of its terms.
8.4 Each of the paragraphs in these Terms operates separately. If any court or relevant authority decides that any of them is unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
8.5 If we do not insist on performing any of your obligations under these Terms or if we do not enforce our rights against you or if we delay in doing so, this does not mean that we have waived our rights against you and does not mean that you should not comply with those obligations. If we waive a default on your part, we will only do so in writing and this does not mean that we will automatically waive any subsequent default on your part.
8.6 If you are a consumer, please note that these Terms are governed by Greek law. This means that a Transaction for the purchase of Products through our website and any dispute or claim arising out of or in connection with it will be governed by Greek law. We both agree that the Greek courts will have non-exclusive jurisdiction. If you are a business, these Terms are governed by Greek law. This means that a Transaction and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-transactional disputes or claims) will be governed by Greek law. We both agree to the exclusive jurisdiction of the Greek courts.
8.7 These Terms and Conditions together with our Website Terms of Use and Privacy Policy, your order and our acceptance of your order, constitute our entire agreement in relation to the supply of goods to you by us. Nothing said by any seller on our behalf should be construed as a modification of these terms and conditions or as an authorised representative as to the nature or quality of the goods offered for sale by us. Except in the case of fraud or fraudulent misrepresentation, we will have no liability for any such statement that is untrue or misleading.
